Do You Need a Permit for a Dumpster in Asheville?

You don’t need a permit for a dumpster on your own driveway or yard in Asheville. You do need one if the dumpster has to sit on a city street or sidewalk: the City of Asheville requires a Right-of-Way Encroachment Permit before delivery. Towns like Woodfin, Weaverville and Biltmore Forest set their own rules, and state roads fall under NCDOT.

Permits are the question we get right after “what size do I need?” Here’s how it works for a dumpster rental in Asheville, and how to skip the paperwork entirely in most cases.

When don’t you need a permit?

  • The dumpster sits on your driveway, parking pad or yard
  • It’s on private property you own or have permission to use, like a jobsite lot
  • It’s in a business parking lot with the owner’s okay

That covers most home projects. A driveway spot is also faster to book, because there’s nothing to wait on.

When do you need a permit in Asheville?

If the box has to go on a public street, sidewalk or alley inside Asheville city limits, you need a City of Asheville Right-of-Way Encroachment Permit before it’s delivered. This happens most on tight downtown and Montford streets, or older homes with no driveway.

On private property, none of these need a permit.

Don’t forget your HOA

Many subdivisions around Asheville have their own rules, even for a dumpster on your driveway. Some limit how many days it can stay or ask for notice first. Check before delivery, so you don’t get a letter from the HOA.

The other permit: demolition and remodeling

This one isn’t about the dumpster, but it catches people off guard. Buncombe County Air Quality requires a permit before you demolish or remodel any building in the county, and older materials should be tested for asbestos first. Asbestos can’t go in a dumpster at all. See what can’t go in a dumpster for the full list.

How to avoid needing a permit

  1. Use the driveway whenever you can. A 10 or 15-yard fits most in-town drives.
  2. Measure first. The truck needs about 60 feet of straight approach and 23 feet of overhead clearance.
  3. Send us a photo of the spot. We’ll tell you if it works before we book.
  4. Pick a smaller box and swap it out if space is tight.
